WILDFISHER — Terms of Use for Motor Boat Rental with Captain

These Terms of Use (hereinafter — the Terms) govern the booking and use of the services offered under the WILDFISHER brand and the use of this website. The services are provided by [UAB IT Architektai] (hereinafter — the Company). Company code: [XXXXXXXXX], VAT payer code: [LTXXXXXXXXXXX], address: [registered address, Lithuania].
1. Definitions
Service — private guided fishing trips aboard the WILDFISHER boat (Finval 515 Evo DC) with captain, on the lake(s) at Palevenėlė, Kupiškis district, and related activity described on the website.
Client — a natural or legal person who books or uses the Service.
Reservation — an order placed through the website's booking form or by any other method agreed with the Company.
2. Acceptance of these Terms
By using the website, submitting an inquiry, or making a Reservation, you confirm that you have read and agree to these Terms and to the Privacy Policy . If you do not agree, please do not use the website or book the Service.
3. Reservation and contract
A Reservation is considered submitted once we receive your completed booking request and confirm it in writing (email or WhatsApp) — a submitted request is not, by itself, a confirmed booking.
Prices, duration, and description of the Service are stated on the website or in an individually agreed offer.
The Company reserves the right to decline a Reservation for objective reasons (e.g., technical failure of the boat, force majeure, safety concerns). In that case we will offer an alternative time or refund any deposit already paid.
Maximum group size per booking: guests (per the reservation form), plus the captain. Larger groups may request a private charter with a second boat.
Please arrive 15–20 minutes before departure at the meeting point listed in your confirmation letter. Boats depart on schedule; late arrivals may shorten the trip without a refund for lost time.
4. Payment
Payment terms (deposit, final payment, accepted payment methods) are stated at the time of booking or in a separate agreement. Unless stated otherwise, the applicable Republic of Lithuania legal rules on payment for services apply.
Prices are per boat, unless stated otherwise at booking. Any additional costs (e.g., extra time on the water, damaged equipment, fishing tackle) will be communicated and invoiced separately.
5. Cancellation and no-show
If you cancel and notify us at least 7 days before the trip — we refund 100% of the trip price.
If you cancel and notify us 3–6 days before the trip — we refund 50% of the trip price.
If you cancel and notify us less than 72 hours before the trip — the trip price is non-refundable.
You may also transfer your reservation to friends or acquaintances free of charge; you must simply notify WILDFISHER's administration of the change (who will be boarding instead) in advance.
If the Client does not arrive at the agreed time and does not notify the Company in advance, the Company may treat the Service as rendered and apply the consequences above (i.e., no refund), the same as a cancellation made less than 72 hours before the trip.
6. Who can come aboard
Minimum age: children under 10 years are not permitted aboard; children under 18 years must be accompanied by a parent/guardian and wear a properly fitted child life jacket at all times.
Guests must disclose in advance any medical condition, mobility limitation, pregnancy, or inability to swim that could affect their safety on the water.
The captain may refuse boarding to any guest who appears intoxicated, is behaving unsafely, or is not properly equipped, without refund.
The number of persons on board (including the captain) will never exceed the boat's certified capacity, regardless of the number booked.
7. Safety and conduct on the water
Boating involves natural conditions and inherent risk. In line with the Lithuanian Law on Safe Navigation and related small-craft safety rules (Republic of Lithuania Law on Safe Navigation ):
Clients must follow the crew's instructions at all times, wear the designated safety equipment (life jackets), and not consume alcohol or narcotic substances before or during the trip where this is prohibited or not agreed with the Company.
A properly fitted life jacket is provided for every person on board and must be worn whenever the boat is underway; it is compulsory for children and strongly required for all guests, regardless of swimming ability.
The boat carries the legally required safety equipment for its engine class, including a lifebuoy with a 30 m floating line, a fire extinguisher, an anchor, and a bailing/dewatering device.
Before departure the captain gives a short safety briefing covering life jacket use, boarding/disembarking, and emergency procedures. Guests must listen to this briefing in full.
The Company has the right to refuse to provide the Service, or to stop the trip, if the Client's behaviour endangers safety or other passengers — without refund for the unused portion.
The captain has final and binding authority over whether, when, and where the boat sails, and this decision cannot be overridden by guests. WILDFISHER captains operate the boat sober; Lithuanian law sets a blood-alcohol limit for vessel operators, and the captain will not sail if that limit could be exceeded (sailing guidance on Lithuanian alcohol limits at sea ).
In an emergency, follow the captain's instructions immediately; the emergency number in Lithuania is 112.
8. Weather and force majeure
Due to bad weather, water levels, crew health, or other circumstances beyond the Company's control, a trip may be rescheduled or cancelled. In such a case we aim to offer another date; refunds follow the agreed terms or applicable legal rules. The Company is not liable for delays, cancellations, or shortened trips caused by such events.
9. Limitation of liability
The Company's liability is limited to the extent permitted by the mandatory provisions of Republic of Lithuania and EU law. The Company is not liable for indirect damage or lost profit, insofar as this does not contradict mandatory legal norms.
The Client is responsible for their own personal belongings on board, unless the loss or damage is proven to result from the Company's fault. Guests are advised to secure phones, cameras, and valuables (waterproof bags recommended).
The Client is responsible for damage to the boat, engine, or equipment caused by their own negligence or by failing to follow the captain's instructions, and may be charged the repair or replacement cost.
Nothing in these Terms limits liability that cannot be excluded under Lithuanian consumer-protection law.
10. Fishing activity
Where the trip includes guided fishing, any species, size, and bag limits under Lithuanian recreational fishing rules apply, and a personal fishing permit may be required depending on the water body and season; the Company will advise Clients in advance whether one is needed for the specific trip.
Caught fish handling (catch-and-release or keep) follows the rules communicated by the guide for that specific water and season.
11. Environment and conduct on the water
No littering; all waste (including bait, line, and packaging) is brought back to shore.
Respect protected areas, nesting sites, and other watercraft; follow the captain's guidance around wildlife.
Photography/video for personal use is welcome; commercial filming on board requires the Company's prior written consent.
12. Intellectual property
The content of the website (texts, design, logos, photographs, unless stated otherwise) belongs to the Company or its licensors. Copying, distributing, or using it for commercial purposes without written consent is prohibited.
13. Data protection
Contact and booking details you provide are used only to manage your reservation, in line with the Company's Privacy Policy . They are not sold to third parties.
14. Complaints and dispute resolution
We accept complaints and requests by email at info@wildfisher.eu or by phone at [+370 XXX XXXXX]. We aim to resolve disputes through direct negotiation; failing that, disputes are governed by the laws of the Republic of Lithuania and fall under the jurisdiction of the Lithuanian courts, unless special consumer-protection rules applicable to the Client provide otherwise (e.g., referral to the State Consumer Rights Protection Authority).
15. Changes to these Terms
We may change these Terms by publishing an updated version on this page. If a Reservation has already been confirmed, the Terms in force at the time of the Reservation apply, unless changes are individually agreed with the Client.
